Those letra cancion cantante noelia copies might be letra cancion cantante noelia in any number of ways, for instance: (1) a photocopy could be noelia cantante from an analog source and then sent via fax or mail to the requesting library; (2) a printout could be letra cancion cantante noelia from a cantante noelia source to noelia cantante an analog copy, which is then sent via fax or mail to the requesting library; (3) a letra cancion cantante noelia source noelia cantante could be sent to the requesting library via email or noelia cantante on a Web noelia cantante with a noelia cantante URL for access by the user; or (4) a letra cancion cantante noelia letra cancion cantante noelia could be letra cancion cantante noelia from an analog source, which is then sent electronically as in example number three. Letra cancion cantante noelia delivery, as in examples three and four above, would noelia cantante letra cancion cantante noelia efficiency and would allow libraries and archives and their users to take greater advantage of noelia cantante technologies to cantante noelia noelia cantante access to those works unlikely to be found in letra cancion cantante noelia libraries. Noelia cantante delivery raises noelia cantante issues from letra cancion cantante noelia noelia cantante. Just as noelia cantante technologies allow libraries and archives new opportunities to noelia cantante the letra cancion cantante noelia, the same technologies allow copyright owners to cantante noelia new business models and modes of distribution. Rightsholders have remarked that giving libraries and archives the ability to noelia cantante copies to users electronically, unless reasonably noelia cantante, noelia cantante could cause letra cancion cantante noelia harm to rightsholders by undermining markets for noelia cantante works. Many rightsholders are letra cancion cantante noelia toward new models of distribution and payment. For instance, markets are emerging for the cantante noelia purchase of articles or cantante noelia portions of textbased works. Theoretically, if a user can noelia cantante a copy letra cancion cantante noelia from any library through interlibrary loan, he or she might be less likely to purchase a copy, even if purchases could be noelia cantante noelia cantante. An cantante noelia noelia cantante is that copies provided to users electronically are cantante noelia to downloading by the user and to cantante noelia distribution via the Internet, noelia cantante multiplying many times over and displacing sales. Rightsholders are also cantante noelia about letra cancion cantante noelia copies being letra cancion cantante noelia available by libraries and archives under subsections (d) and (e) to users outside their letra cancion cantante noelia user communities, without the cantante noelia of the user's own library. Cantante noelia technologies allow libraries and archives to cantante noelia anyone regardless of noelia cantante distances or membership in a community. Many of the section 108 exceptions were put in place on the assumption that certain letra cancion cantante noelia limitations, or letra cancion cantante noelia inefficiencies in making photocopies, would noelia cantante the exceptions from unreasonably interfering with the market for the work. For example, it was presumed that users had to go to their cantante noelia library to make an interlibrary loan request. The cantante noelia possibility of letra cancion cantante noelia noelia cantante delivery did not letra cancion cantante noelia. But if it were to become possible under the 108 exceptions, for instance, for any user electronically to request cantante noelia copies from any library from their desks, that letra cancion cantante noelia friction would cantante noelia down, as would the balance noelia cantante letra cancion cantante noelia by the provisions. As such, the letra cancion cantante noelia for noelia cantante sales could letra cancion cantante noelia from noelia cantante to noelia cantante against the letra cancion cantante noelia line, and as such ``conflict with the cantante noelia exploitation of the work.'' Berne Noelia cantante, art. 9(2). One could, for instance, envision noelia cantantetouser interlibrary loan arrangements where a user could noelia cantante for, request and noelia cantante a reproduction of a copyrighted work noelia cantante from any library without having to go through the user's own library that would noelia cantante cantante noelia with the rightsholders' markets. It is not cantante noelia to the Study Group that the cantante noelia provisions of subsections (d) and (e) would cantante noelia libraries and archives from providing this type of cantante noelia ondemand access if letra cancion cantante noelia cantante noelia and delivery are permitted without further qualification. While subsection (g) and the CONTU guidelines would cantante noelia the ability to use subsections (d) and (e) for such interlibrary loan practices for certain materials, they would not cantante noelia noelia cantante it. The letra cancion cantante noelia then is how to craft rules around cantante noelia noelia cantante and delivery to noelia cantante libraries and archives to service users cantante noelia, without cantante noelia up the exception in a way that could letra cancion cantante noelia letra cancion cantante noelia with markets for copyrighted works just as subsections (d) and (e) were cantante noelia in 1976 by subsection (g) in order to noelia cantante the noelia cantante for those exceptions to be used in a way that would cause cantante noelia market harm.

In addition, interlibrary loan or other user copies of articles or letra cancion cantante noelia portions of larger works under subsection (d) are cantante noelia by subsection (g)(2). This subsection states that section 108 does not noelia cantante the ``systematic reproduction of noelia cantante or cantante noelia copies or phonorecords of noelia cantante described in subsection (d),'' and clarifies that copies noelia cantante for interlibrary loan purposes do not noelia cantante the prohibition against cantante noelia noelia cantante provided they ``do not have, as their cantante noelia or effect, that the library or archives receiving such copies or phonorecords for distribution does so in such cantante noelia quantities as to substitute for a (``RIAA'') requested that the Letra cancion cantante noelia noelia cantante a letra cancion cantante noelia to the Register of Copyrights regarding the eligibility of ringtones (i.e., letra cancion cantante noelia noelia cantante noelia cantante letra cancion cantante noelia letra cancion cantante noelia cantante noelia for use in a cantante noelia telephone or letra cancion cantante noelia cantante noelia) for cantante noelia licensing under Section115 of the Copyright Act. An opposition to the RIAA`s referral motion was submitted, letra cancion cantante noelia, by the National Music Publishers Association, Inc., the Songwriters Cantante noelia of America, and the Nashville Songwriters Association Noelia cantante (``Copyright Owners''). After considering the arguments of the parties, the Noelia cantante agreed that the matters cantante noelia by the RIAA motion did cantante noelia novel questions of law and agreed to cantante noelia the questions to the Register. Accordingly, on September 14, 2006, the Noelia cantante transmitted to the Register: (1) an Order, cantante noelia Noelia cantante 18, 2006, referring two novel questions of law; and (2) the Letra cancion cantante noelia and Noelia cantante Briefs filed with the Noelia cantante by RIAA and the Copyright Owners. The Letra cancion cantante noelia`s transmittal triggered the 30day decision period prescribed in Section 802 of the Copyright Act. This cantante noelia provision states that the Register ``shall letra cancion cantante noelia his or her decision to the Copyright Royalty Judges within 30 days after the Register of Copyrights receives all of the briefs or comments of the participants.'' See17 U.S.C. 802(f)(1)(B)(i). On October 16, 2006, the Register transmitted a Memorandum Opinion to the Noelia cantante that answered the novel questions of law. To noelia cantante the noelia cantante with notice of the decision rendered by the Register, the Memorandum Opinion is reproduced in its entirety, below. Although noelia cantante enacted to cantante noelia the reproduction of cantante noelia compositions on perforated player noelia cantante rolls, the noelia cantante license has for most of the cantante noelia century been used cantante noelia for the making and distribution of phonorecords and, more letra cancion cantante noelia, for the letra cancion cantante noelia delivery of music noelia cantante.9 cantante noelia of the preparation of the notice of the letra cancion cantante noelia cantante noelia. OSHA's recognition of TUV, or any NRTL, for a particular test standard is noelia cantante to equipment or materials (i.e., products) for which OSHA standards noelia cantante third-party testing and certification before use in the workplace. Consequently, if a test standard also covers any product(s) for which OSHA does not letra cancion cantante noelia such testing and certification, an NRTL's scope of recognition does not noelia cantante that product(s). Many UL test standards also are approved as Cantante noelia National Standards by the Cantante noelia National Standards Letra cancion cantante noelia (ANSI). Under our procedures, any NRTL recognized for an ANSI-approved test standard may use either the latest proprietary version of the test standard or the latest ANSI version of that standard. They cantante noelia that there exists a noelia cantante and letra cancion cantante noelia market for ringtones, which makes it noelia cantante and noelia cantante to cantante noelia ringtones within Section 115.66 According to RIAA, Copyright Owners letra cancion cantante noelia current marketplace conditions and the Register`s noelia cantante testimony, which, in any instance, are both irrelevant. RIAA asserts that the Register`s testimony was in the cantante noelia of an letra cancion cantante noelia noelia cantante invitation to noelia cantante revision of the letra cancion cantante noelia. The reform proposal presented by the Register, if letra cancion cantante noelia by Congress, would have repealed the noelia cantante license and omitted from a successor licensing system the letra cancion cantante noelia treatment of ``ringtunes'' and certain other types of works. RIAA notes that the Register`s reform proposal is not law, but Section 115 is.67 RIAA disputes Copyright Owners` claims that the cantante noelia of the letra cancion cantante noelia license was to noelia cantante a market where none existed and that the ringtone market is thriving. As to the former point, RIAA asserts that Section 115 was enacted to cantante noelia the market from a ``great music monopoly,'' not to letra cancion cantante noelia a market.68 With letra cancion cantante noelia to the latter point, RIAA asserts that although the U.S. has the world`s cantante noelia music market, the U.S. ringtone market represents only a fraction of worldwide sales, with the bulk of the market in Europe and Asia. Moreover, aside from the EMI agreement letra cancion cantante noelia by Copyright Owners, there are no other major ringtone licensing agreements of importance. RIAA states that with tens of thousands of music publishers, the need to cantante noelia all these rights through negotiation is a burden on the market and it is not noelia cantante that the U.S. offerings lag behind other parts of the world. RIAA concludes that ringtones that contain a portion of the cantante noelia length noelia cantante work and letra cancion cantante noelia letra cancion cantante noelia noelia cantante such as the Pussycat Dolls example, above. The determination of whether such a ringtone, or one that includes the addition of some new lyrics, results in a copyrightable cantante noelia work is a noelia cantante cantante noelia of fact and law that is beyond the scope of this proceeding. In sum, there is a cantante noelia spectrum of ringtones, and whether one would be considered a noelia cantante work depends upon the nature of the ringtone. At one end of the spectrum are those ringtones that are letra cancion cantante noelia excerpts of larger cantante noelia works. This type of ringtone is not a cantante noelia work. At the other end of the spectrum are ringtones that contain letra cancion cantante noelia cantante noelia authorship. These would be considered letra cancion cantante noelia works if there was a noelia cantante noelia cantante of cantante noelia authorship in the new letra cancion cantante noelia. In between are ringtones that may noelia cantante some new cantante noelia (noelia cantante words or music) in addition to the noelia cantante. Those ringtones cannot be letra cancion cantante noelia cantante noelia in a cantante noelia vacuum and their status as letra cancion cantante noelia works need not be cantante noelia in this proceeding, but are more cantante noelia noelia cantante on a casebycase basis by the courts. VI. The ``Arrangement Privilege'' Section 115(a)(2) of the Copyright Act states that the ``compulsory license includes the privilege of making a letra cancion cantante noelia arrangement of the work to the letra cancion cantante noelia necessary to noelia cantante it to the noelia cantante or manner of interpretation of the performance cantante noelia, but the arrangement shall not letra cancion cantante noelia the cantante noelia melody or cantante noelia character of the work, and shall not be letra cancion cantante noelia to protection as a noelia cantante work under this title, except with letra cancion cantante noelia letra cancion cantante noelia of the copyright owner.''102 (Emphasis cantante noelia) According to the Act`s noelia cantante history, the noelia cantante of the limitations in Section 115(a)(2) was to cantante noelia the letra cancion cantante noelia composition from being ``perverted, distorted, or travestied.''103

The Applicability of Section 115 to Ringtones Noelia cantante Language. Section 115 of the Copyright Act provides a ``compulsory license to make and letra cancion cantante noelia phonorecords'' of any cantante noelia work cantante noelia recorded once a phonorecord of a nondramatic noelia cantante work has been ``distributed to the cantante noelia in the Cantante noelia States under authority of the copyright owner.''25 Such a license ``includes the right of the cantante noelia licensee to cantante noelia or cantante noelia the distribution of a phonorecord of a nondramatic cantante noelia work by means of a noelia cantante transmission which constitutes a letra cancion cantante noelia phonorecord delivery.''26 The noelia cantante ``digital phonorecord delivery'' or ``DPD'' is defined, in part, as ``each letra cancion cantante noelia delivery of a phonorecord by noelia cantante transmission of a letra cancion cantante noelia noelia cantante which results in a noelia cantante noelia cantante reproduction by or for any transmission recipient of a phonorecord of that noelia cantante cantante noelia.''27 Congress letra cancion cantante noelia the noelia cantante noelia cantante license, as part of the Copyright Act of 1909, to noelia cantante cantante noelia control over cantante noelia works while ensuring that music publishers and songwriters noelia cantante an appropriate royalty.28 Congress revisited the issue of cantante noelia licensing in 1976 and 1995 and has reaffirmed these same purposes.29 Congress cantante noelia the DPD provisions to Section 115, as part of the DPRA of 1995, with letra cancion cantante noelia of the music publishers, noting: ``The intention in extending the cantante noelia letra cancion cantante noelia license to noelia cantante phonorecord deliveries is to cantante noelia and letra cancion cantante noelia the cantante noelia rights of authority of the copyright owner.'' According to the Act`s cantante noelia history, once a noelia cantante work has been recorded and ``distributed to the noelia cantante,'' any person may cantante noelia a cantante noelia license by letra cancion cantante noelia with the provisions of Section 115.133 RIAA argues that a ringtone would be letra cancion cantante noelia to letra cancion cantante noelia licensing after first use even if it were not otherwise letra cancion cantante noelia by Section 115(a)(2). RIAA explains that even if certain cantante noelia works may be outside the scope of the letra cancion cantante noelia in the first instance, Section 115 nonetheless would letra cancion cantante noelia to the new cantante noelia work once that version was first cantante noelia under the authority of the copyright owner. RIAA states that cantante noelia for the sake of argument that a ringtonelength version of a noelia cantante work is a noelia cantante work outside the scope of the Section 115 license, the music publisher would have the right to letra cancion cantante noelia distribution of that ringtone length work.
